Terms of Service

1. Acceptance of Terms

By accessing or using the ARCA Community website, applying for membership, or participating in any ARCA events and services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree with these Terms, you must not use our services.

ARCA Community (“ARCA,” “we,” “us,” or “our”) reserves the right to modify these Terms at any time. Continued use of our services following any changes constitutes acceptance of the revised Terms.

2. Membership Terms

ARCA operates as an invitation-only cultural collective. Membership is granted at the sole discretion of our membership committee and is subject to the following conditions:

• Membership is personal and non-transferable
• ARCA reserves the right to accept or decline any application without providing a reason
• Membership may be revoked at any time if a member violates these Terms, breaches the community code of conduct, or acts in a manner inconsistent with ARCA’s values
• Membership fees, once paid, are non-refundable except where required by applicable law
• Members must maintain accurate and up-to-date personal information in their profiles

3. Member Conduct

As a member of the ARCA community, you agree to uphold the highest standards of conduct. Members are expected to:

• Treat all members, staff, partners, and guests with respect and courtesy
• Maintain the confidentiality of community events, spaces, and fellow member information
• Refrain from any behaviour that is discriminatory, harassing, threatening, or otherwise inappropriate
• Respect the physical spaces, property, and ambience of ARCA venues
• Follow all venue-specific rules, dress codes, and guidelines communicated by ARCA staff
• Not engage in any commercial solicitation or promotional activities without prior written consent from ARCA

Violation of these conduct standards may result in immediate membership termination without refund.

4. Credits System

ARCA operates an internal credits system for access to curated events and experiences. The following terms apply:

• Credits are non-refundable and cannot be exchanged for cash or monetary value
• Credits are used to reserve and attend ARCA events, dinners, workshops, and other curated experiences
• Unused credits do not carry over between membership periods unless explicitly stated
• ARCA reserves the right to modify the credits system, including pricing and allocation, with reasonable notice to members
• Credits are personal and may not be transferred, sold, or gifted to non-members

5. Events and Experiences

ARCA curates exclusive events and cultural experiences for its members. Regarding participation:

• Event availability is limited and confirmed on a first-come, first-served basis
• ARCA reserves the right to cancel, reschedule, or modify events at any time, in which case credits will be refunded
• Members are responsible for their behaviour and that of any guests they invite to events
• Photography and recording policies vary by event and must be respected at all times

6. Intellectual Property

All content on the ARCA website and within our platforms — including but not limited to text, graphics, logos, images, videos, brand identity, and design elements — is the exclusive property of ARCA Community or its licensors and is protected by applicable intellectual property laws.

• You may not reproduce, distribute, modify, or create derivative works from any ARCA content without prior written permission
• The ARCA name, logo, and all related marks are trademarks of ARCA Community. Unauthorised use is strictly prohibited
• Content shared by members within the community remains the property of the respective creator, with a limited licence granted to ARCA for community purposes

7. Limitation of Liability

To the maximum extent permitted by applicable law:

• ARCA provides its services and experiences on an “as is” and “as available” basis without warranties of any kind, either express or implied
• ARCA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or attendance at our events
• ARCA’s total liability to any member shall not exceed the amount of membership fees paid by that member in the 12 months preceding the claim
• ARCA is not responsible for any personal injury, property damage, or loss incurred during events unless caused by ARCA’s gross negligence or wilful misconduct

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. By using our services, you acknowledge that you have read and understood our Privacy Policy.

9. Termination

Either party may terminate membership as follows:

• By the member: You may cancel your membership at any time by contacting us at membership@arcacommunity.com. No refund will be provided for the remaining membership period
• By ARCA: We may terminate or suspend your membership immediately, without prior notice, for conduct that violates these Terms or is harmful to the community

Upon termination, your access to member benefits, events, and the ARCA platform will cease. Any unused credits will be forfeited.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain.

11. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
